國(guó)務(wù)院印發(fā)《保障中小企業(yè)款項(xiàng)支付條例》,自two thousand and twentyyearninemonthoneIt shall come into force on the twoonest.支付工程款不得超過(guò)six0天,逾期支付利息。
國(guó)務(wù)院第7two8號(hào)令《保障中小企業(yè)款項(xiàng)支付條例》,自two thousand and twentyyearninemonthoneIt shall come into force on the twoonest.為保障中小企業(yè)被拖欠的款項(xiàng)及時(shí)支付,《條例》規(guī)定:
機(jī)關(guān)、事業(yè)單位從中小企業(yè)采購(gòu)貨物、工程、服務(wù),應(yīng)當(dāng)自貨物、工程、服務(wù)交付之日起three0日內(nèi)支付款項(xiàng);合同另有約定的,付款期限最長(zhǎng)不得超過(guò)six0日。
要求施工單位對(duì)政府投資項(xiàng)目墊資的,將對(duì)機(jī)關(guān)、事業(yè)單位追究責(zé)任。
不得以法定代表人或者主要負(fù)責(zé)人變更,履行內(nèi)部付款流程,或者在合同未作約定的情況下以等待竣工驗(yàn)收批復(fù)、決算審計(jì)等為由,拒絕或者遲延支付中小企業(yè)款項(xiàng)。
機(jī)關(guān)、事業(yè)單位和大型企業(yè)遲延支付中小企業(yè)款項(xiàng)的,應(yīng)當(dāng)支付逾期利息。雙方對(duì)逾期利息的利率有約定的,約定利率不得低于合同訂立時(shí)oneyear期貸款市場(chǎng)報(bào)價(jià)利率;未作約定的,按照每日利率萬(wàn)分之五支付逾期利息。
使用商業(yè)匯票等非現(xiàn)金支付方式支付中小企業(yè)款項(xiàng)的,應(yīng)當(dāng)在合同中作出明確、合理約定,不得強(qiáng)制中小企業(yè)接受商業(yè)匯票等非現(xiàn)金支付方式,不得利用商業(yè)匯票等非現(xiàn)金支付方式變相延長(zhǎng)付款期限。
不得強(qiáng)制要求以審計(jì)機(jī)關(guān)的審計(jì)結(jié)果作為結(jié)算依據(jù),但合同另有約定或者法律、行政法規(guī)另有規(guī)定的除外。
不得將保證金限定為現(xiàn)金。中小企業(yè)以金融機(jī)構(gòu)保函提供保證的,機(jī)關(guān)、事業(yè)單位和大型企業(yè)應(yīng)當(dāng)接受。
中小企業(yè)與機(jī)關(guān)、事業(yè)單位、大型企業(yè)訂立合同時(shí),應(yīng)當(dāng)主動(dòng)告知其屬于中小企業(yè)。對(duì)中小企業(yè)規(guī)模類(lèi)型有爭(zhēng)議的,可以向主張為中小企業(yè)一方所在地的縣級(jí)以上地方人民政府負(fù)責(zé)中小企業(yè)促進(jìn)工作綜合管理的部門(mén)申請(qǐng)認(rèn)定。
有關(guān)行業(yè)、協(xié)會(huì)、商會(huì)應(yīng)當(dāng)禁止本行業(yè)大型企業(yè)利用優(yōu)勢(shì)地位拒絕或者遲延支付中小企業(yè)款項(xiàng)。
機(jī)關(guān)、事業(yè)單位和大型企業(yè)不得要求中小企業(yè)接受不合理的付款期限、方式、條件和違約責(zé)任等交易條件,不得違約拖欠中小企業(yè)的貨物、工程、服務(wù)款項(xiàng)。
使用財(cái)政資金從中小企業(yè)采購(gòu)貨物、工程、服務(wù),應(yīng)當(dāng)嚴(yán)格按照批準(zhǔn)的預(yù)算執(zhí)行,不得無(wú)預(yù)算、超預(yù)算開(kāi)展采購(gòu)。
0nine、企業(yè)資質(zhì)

近日,住建部印發(fā)《建設(shè)工程企業(yè)資質(zhì)管理制度改革方案》。
改革后:工程勘察資質(zhì)分為綜合資質(zhì)和專(zhuān)業(yè)資質(zhì);工程設(shè)計(jì)資質(zhì)分為綜合資質(zhì)、行業(yè)資質(zhì)、專(zhuān)業(yè)和事務(wù)所資質(zhì);施工資質(zhì)分為綜合資質(zhì)、施工總承包資質(zhì)、專(zhuān)業(yè)承包資質(zhì)和專(zhuān)業(yè)作業(yè)資質(zhì);工程監(jiān)理資質(zhì)分為綜合資質(zhì)和專(zhuān)業(yè)資質(zhì)。資質(zhì)等級(jí)原則上壓減為甲、乙兩級(jí)(部分資質(zhì)只設(shè)甲級(jí)或不分等級(jí)),資質(zhì)等級(jí)壓減后,中小企業(yè)承攬業(yè)務(wù)范圍將進(jìn)一步放寬,有利于促進(jìn)中小企業(yè)發(fā)展。
文件還提到做好資質(zhì)標(biāo)準(zhǔn)修訂和換證工作,確保平穩(wěn)過(guò)渡,設(shè)置oneyear過(guò)渡期,到期后實(shí)行簡(jiǎn)單換證,即按照新舊資質(zhì)對(duì)應(yīng)關(guān)系直接換發(fā)新資質(zhì)證書(shū),不再重新核定資質(zhì)。

two thousand and twentyyearonetwomonthnine日,住房和城鄉(xiāng)建設(shè)部印發(fā)《建筑市場(chǎng)信用信息分級(jí)標(biāo)準(zhǔn)(征求意見(jiàn)稿)》并向社會(huì)公開(kāi)征求意見(jiàn)。加快推進(jìn)建筑市場(chǎng)信用體系建設(shè)、規(guī)范建筑市場(chǎng)秩序。
明確:one、建筑市場(chǎng)失信行為信息實(shí)行分級(jí)管理,按照性質(zhì)、危害程度的不同分為A級(jí)、B級(jí)、C級(jí)等失信等級(jí)。A級(jí)失信行為信息的公開(kāi)期限為six個(gè)month——threeyear;B級(jí)失信行為信息的公開(kāi)期限為three個(gè)month——oneyear;C級(jí)失信行為信息的公開(kāi)期限為one個(gè)month——six個(gè)month。建筑市場(chǎng)主體“黑名單”信息管理期限為自被列入名單之日起oneyear。
